Referred hereinafter as 'Podcast.co', 'our', 'we' and 'us'; is an internet service provider. All customers under our service are subject to the terms and conditions described in this document.
Podcast.co reserves the right to make alterations to this document whenever we deem reasonable. It is the client's sole responsibility to check this document for updates on a regular basis.
Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services and those additional terms become part of your agreement with us if you use those Services.
All material on this site, including but not limited to text, images, illustrations, code, scripts and audio clips/live audio is protected by copyrights which are owned and controlled by Podcast.co. Material from this website may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, unless we give you the written permission to do so.
Do not misuse our Services, for example, do not interfere with our Services or try to access them using a method other than the interface and the instructions that we provide.
You may use our Services only as permitted by law, including applicable export and control laws and regulations. You may not use our services to distribute illegal or unsociable material. If you are breaking laws, being obscene, spreading false information (including Covid-19), or abusing our infrastructure, we have the right to suspend your account. Failure to comply will result in Podcast.co terminating your account with immediate effect. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Any cease and desist request received from a federal body will be complied with and your service may be terminated without notice.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content that you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Do not remove, obscure or alter any legal notices displayed in or along with our Services.
1.1 Reselling Podcast.co products and services without our prior consent is strictly prohibited.
Our Services display some content from third parties. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law. But that does not necessarily mean that we review content, so please do not assume that we do.
In connection with your use of the Services we may send you service announcements, administrative messages and other information. You may opt out of some of those communications.
1.2 Fair Usage Policy
API resources for Podcast.co products are shared with other users of the system and clients are required to understand this. We reserve the right to monitor, restrict, suspend API access or bill clients found to be using a disproportionate level of shared resources on a regular basis.
File storage is reserved exclusively for Podcast episodes, published or unlisted. While we offer no limits on episode file storage per account, this resource is shared between other users. If we find excessive use of storage we may reach out to you to discuss options.
Features such as Audiograms by Headliner and Transcription have soft limits of 2 hours per podcast per month. Excessive usage of these services may incur an additional charge.
Standard accounts (purchased via our website) include specific account level download allowances (available on our pricing page). If your podcast exceeds this download allowance we will reach out to you to discuss options. Please see section 2.4 Overages for more details.
If distributing episode download links, users should only share the URL available within their dashboard (downloads.pod.co....). Sharing alternate URLs or reverse engineering Podcast.co to obtain other URLs is not permitted and may result in suspension of service.
We do not provide any form of legal cover to any individual or company who utilize our services to distribute content with any copyright protection. Under no circumstances will Podcast.co be responsible for the behaviour of our clients or their users when found to have recorded protected content. All licensing, copyright and royalty issues are the sole responsibility of the individual clients and/or their production entities.
Podcast.co does not provide any form of music licensing or coverage for royalties. Also some directories prohibit the use of copyrighted music in podcasts. We recommend always consulting with qualified professionals or the relevant authorities for your country regarding copyright and licensing. If a podcast or episode is identified as infringing any form of copyright, the infringing content will be removed immediately in line with the claimant's request. We will notify you of such requests within 24 hours of receipt. To reduce the risk of copyright related issues we advise against publishing any content which contains copyrighted material beyond the duration considered as 'fair use'.
While Podcast.co believes in free speech, however content that directly discriminates others (including but not limited to: racism, sexism, sexual orientation discrimination) is not permitted on the platform. Promotion of content that is deemed as misinformation is prohibited. Podcast.co does not actively monitor shows, however any complaints received regarding podcasts hosted on our platform will be investigated fully. During the investigation we may temporarily suspend your podcast or make unavailable an infringing episode.
If contacted by an authority in the event of an illegal situation regarding the distribution of adult, racist or any other un-sociable material, we will co-operate fully in any investigations they decide to make against clients found to be breaking the law.
We may suspend or stop providing our services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct. Failure to comply will result in Podcast.co terminating your account with immediate effect.
Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.
Services are billed on a monthly or yearly subscription basis unless otherwise specified. Payment will be collected on a specific billing date either 1 month or 1 year from the initial payment date automatically and will continue until a cancellation request is received via the correct method (see below). Failure to pay for services delivered will result in suspension of service and/or late payment fees in accordance with the Late Payment of Commercial Debt Act (1998). If services are left unpaid for an extended period of time we reserve the right to remove the service (including all data) from our servers without notice.
2.1 Trials:
All our plans include a 14 day trial period. You must provide a payment method at point of sign up. At the end of the trial period your account will automatically activate and you will be charged for your first month or year depending on the billing period selected at signup. You can cancel your trial at any time during the trial period by visiting your account settings within our dashboard then clicking 'Manage Subscription'.
2.2 Missed Payments
Our billing system will attempt payment automatically from your stored payment method on either your monthly or annual renewal date. If payment fails you will receive an email detailing this. Further payment attempts will be made up to a week after initial failure (dunning).
If you are experiencing issues making your payment please contact your card issuer as they will be able to provide details about the failure. You may also wish to reach out to our support team.
If all payment attempts are exhausted your account will be cancelled. Please be aware cancelled accounts are removed from our system 60 days after the cancellation date. You can reactivate your account at any time within this period to restore your podcast. If you reactivate after this time you will be issued a new empty account.
2.2 Cancellation:
All payments billed to existing clients are non-refundable, clients wishing to cancel their service should do so by contacting one of the team using the messenger within their account at least 7 days before their next billing date, or within their trial period. Our base pricing is laid out in US Dollars ($), pricing in Euros (€) and British Pounds (£) is for your convenience and may be subject to change depending on current exchange rates. If we plan a price revision we will provide at least 60 days notice. Cancelling a PayPal or Card subscription directly without notifying us may result in an automated termination of service and loss of data.
If your cancellation has been successful, your service will continue until the end of your current billing period, unless refunded, then your service will be terminated immediately.
Upon account cancellation your podcast will enter an archived state. It will remain in this state for 60 days in the event you may wish to recover it from our system. After this date any data from your account will be permanently deleted.
All standard plans offer a 24 hour 'cooling off' period for new customers after their trial period. Refunds are available for 24 Hours after any payment has been collected from a new customer for a new service, providing the service(s) provided have not been used excessively.
It is the clients responsibility to keep track of all payments made. Any refunds to existing customers or given after the 24 hour cooling off period will be made entirely at our discretion and may be subject to administrative charges.
Unless otherwise stated in writing our standard discount is 10% in exchange for a banner placement on your website and discounts are only available to non-profit organisations with a registered charity number. Any discounts offered by Podcast.co are done at our sole discretion.
You are not liable for any form of refund if you have breached the terms of service in any way.
2.4 Overages
Our standard plans include monthly download limits. These are on the account level and apply to the total number of downloads across your whole network. If you exceed your monthly download allowance we will reach out to you to make you aware. We may suggest upgrading to the next available plan.
Please note if we reach out but do not hear back we may automatically upgrade you to the next plan if you continue to use more than your plan allowance on recurring months. We will notify you via your account email address 24 hours prior to any charge.
Our top plan (Premium) allows up to 200,000 monthly downloads. If your show or network attracts more than this please contact us to discuss custom pricing.
Any significant overage use in any one month may result in an overage fee for that month. General overage fees apply to the following plans:

Overage fees are applied to invoices in arrears. Notice of overage payments will be sent 48 hours before any payment is collected. If you receive overage invoices frequently we strongly suggest reaching out so we can discuss a custom plan.
Users on an annual plan who go over their allowance in any one month will receive an overage invoice for that particular month.
If you are on a custom plan please find overage details in your billing agreement. Contact support to obtain this.
If you are on a promotional plan (e.g. AppSumo 1, 2, 3 codes) overages are calculated in a different way. Please see below:
AppSumo accounts allow unlimited listeners however bandwidth is reserved at 500GB (Approx 25,000 downloads*) per account per month. If bandwidth usage exceeds 10% of the reserved amount over concurrent months we may reach out to you to discuss options. This may include, but not be limited to an Additional Bandwidth add-on. If bandwidth usage exceeds 25% of the reserved amount we may apply an overage charge to your next payable invoice. Overages are charged at $25/TB or equivalent in other currencies.
*Based on a 128Kbps 22 minute episode.
3.1 General
From time to time Podcast.co may run promotions or provide promo codes. Any promotional codes released are for use on new accounts only and cannot be retrospectively applied.
Podcast.co has the right to withdraw any promotional campaign or codes at any time without prior notice.
3.3 Current Promotions
Mystery Discount
Save a percentage off your current plan for a specified amount of time. Applies to Lite, Growth or Premium plans on either monthly or annual billing. Customer will be eligible for discount upon receipt of a code via email. One offer per customer.
We may amend or withdraw this offer at any time.
3.3 Expired Promotions
Black Friday 2021 - Save 50% off Starter Plans for the first 12 months.

Customers who require technical support can contact us at any time via the messenger within their Podcast.co account.
4.1 General Support terms
Attempting to seek support via any other channel such as sales email may delay or prevent any response from the support team. Corporate customers who require a dedicated account manager, or guaranteed response times should contact us to arrange a premium service level agreement. We regret that we are unable to provide technical support via other lines of communication such as telephone or live chat to clients on our standard support agreement. This is enforced due to the nature of our business and to ensure a fair level of service to the large number of customers who we serve.
To aid our customer service representatives, it is important for clients to include a clear outline of account information, system reference numbers and adequate details of any problems when submitting a request to our support department, with a detailed description and screenshots where required. Failure to do so will result in a delayed response and/or resolution times.
Clients are expected to be courteous and professional in their communications to Podcast.co. Under no circumstances will we tolerate any kind of verbal, physical, written or other abuse (including threats of abuse, retribution or ticket desk spamming) of any Podcast.co customer, employee, member, or officer will result in immediate account termination.
Podcast.co agrees to offer support to clients only on topics directly relating to our services and our technical support team are there to assist clients with any problems directly relating to the availability or functionality of our service. Our support service does not cover generic computer or website advice. We always try to help clients as much as possible, however, it is important for clients to acknowledge that their hardware/software setup is unique and it is not always possible for our support technicians to offer 100% resolution of all problems. In these cases we will attempt to offer 'Best Effort' support. Clients are expected to do their own research and seek training on such matters. We do not offer support for third-party services. Clients will need to seek advise from the third party vendor.
Any views, information or opinions presented in any communication from a Podcast.co staff member are solely those of the author and do not necessarily represent those of the company.
Live sales chat is available during standard office hours. This is designed for quick questions and sales queries only. If a client requires support they should use the official methods stated above. Our sales chat operators will not tolerate abuse or profanity. If used we reserve the right to evaluate the status of your services with us (if applicable) which could result in account suspension.

4.2 Basic Support (Promotional, Starter & Lite Plan)
Promotional (e.g. AppSumo), Starter & Lite plan customers have access to our help centre (https://help.podcast.co). They can also contact our support team via help@podcast.co or the help centre messenger. Response times are up to 5 business days.
4.3 Standard Support (Growth & Premium Plan)
Growth & Premium plan customers have access to our help centre (https://help.podcast.co). They can also contact our support team via help@podcast.co or the help centre messenger. Response times are up to 1 business day.
(This level also applies to our grandfathered Pro & Business plans)
4.4 Enhanced Support (Enterprise Clients)
Your level of support will be agreed upon signup. As well as access to our help centre and messenger you will also receive access to a dedicated email address.
Some of our Services allow you to upload, submit, store, send or receive content You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.
When you upload, submit, store, send or receive content intended for public consumption to or through our Services, you give Podcast.co (and those we work with) a worldwide licence to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes that we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights that you grant in this licence are for the limited purpose of operating, promoting and improving our Services, and to develop new ones. Some Services may offer you ways to access and remove content that has been provided to that Service. Where your uploaded content is used with our private shows feature, Podcast.co will respect this. We may reach out to you for written permission to promote your brand as a customer on our social media or marketing website.
Also, in some of our Services, there are terms or settings that narrow the scope of our use of the content submitted in those Services. Make sure that you have the necessary rights to grant us this licence for any content that you submit to our Services.
Podcast.co core hosting does not require third party software to upload or manage your shows.
When a Service requires or includes downloadable software, this software may be updated automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.
Podcast.co gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive licence to use the software provided to you by Podcast.co as part of the Services. This licence is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Podcast.co in the manner permitted by these terms. You may not copy, modify, distribute, sell or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
Open-source software is important to us. Some software used in our Services may be offered under an open-source licence that we will make available to you. There may be provisions in the open-source licence that expressly override some of these terms.
Some services offered by Podcast.co may be provided by third parties (such as Audiograms and Transcription). Use of these services may require personal information (your name and account email address) to be sent to the provider. By accepting use of those features you agree to have this data shared with the provider. No other personal information is shared. Third party services may contact you by email relating to the use of their product.
We are constantly changing and improving our Services. We may add or remove functionalities or features and we may suspend or stop a Service altogether.
You can stop using our Services at any time, although we would be sorry to see you go. Podcast.co may also stop providing Services to you or add or create new limits to our Services at any time.
We believe that you own your data, and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to remove information from that Service.
We provide our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we do not promise about our Services.
Other than as expressly set out in these terms or additional terms, neither Podcast.co nor its suppliers or distributors makes any specific promises about the Services. For example, we do not make any commitments about the content within the Services, the specific functions of the Services or their reliability, availability or ability to meet your needs. We provide the Services “as is”.
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.
When permitted by law, Podcast.co and Podcast.co’s suppliers and distributors will not be responsible for lost profits, revenues or data, financial losses or indirect, special, consequential, exemplary or punitive damages.
To the extent permitted by law, the total liability of Podcast.co and its suppliers and distributors for any claims under these terms, including for any implied warranties, is limited to the amount that you paid us to use the Services (or, if we choose, to supplying you with the Services again).
In all cases, Podcast.co and its suppliers and distributors will not be liable for any loss or damage that is not reasonably foreseeable.
We recognise that in some countries, you might have legal rights as a consumer. If you are using the Services for a personal purpose, then nothing in these terms or any additional terms limits any consumers’ legal rights which may not be waived by contract.
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Podcast.co and its affiliates, officers, agents and employees from any claim, action or proceedings arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, judgements, litigation costs and legal fees.
We may modify these terms or any service-specific terms, for example, to reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retrospectively and will become effective no earlier than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.
If there is any inconsistency between these terms and the additional terms, the additional terms will prevail to the extent of the inconsistency.
Any charges laid out in these terms are presented in US Dollars ($). If your subscription is billed in any other currency we will use the current day's exchange rate to process any charges due.
These terms govern the relationship between Podcast.co and you. They do not create any third party beneficiary rights.
If you do not comply with these terms and we do not take action immediately, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
If it turns out that a particular term is not enforceable, this will not affect any other terms.
